Welcome to EquipMarket. These Terms & Conditions (“Terms”) govern your access to and use of the heavy equipment marketplace at equipmarket.org (the “Platform”). By using the Platform, creating a listing, or opting in to our text messaging program, you agree to these Terms.

1. The Platform

EquipMarket is an online marketplace that connects sellers and buyers of heavy construction equipment and provides optional marketing, brokerage, and buyer-financing services. EquipMarket is not the manufacturer, owner, or guarantor of equipment listed by third parties.

2. Listings

Listing equipment is free. You are responsible for the accuracy of all information you post, including make, model, year, hours, condition, price, and ownership. You represent that you have the legal right to sell any equipment you list. We may review, edit, or remove listings that violate these Terms or our policies.

3. Fees & Commission

Creating a listing carries no upfront cost. For managed or brokered sales, a commission of 6%–10% of the final sale price applies only upon a successful sale, as described in the applicable listing or consignment agreement. Self-service (DIY) listings you sell independently carry no commission.

4. Buyer Financing

We offer optional buyer financing through third-party lending partners. Financing estimates shown on the Platform are illustrative only and are not an offer of credit. Any financing is subject to the lender’s application, underwriting, and approval. EquipMarket is not a lender.

5. Transactions Between Users

Except where EquipMarket acts as a brokerage under a separate signed agreement, transactions are conducted directly between buyer and seller. You are responsible for your own inspection, negotiation, payment, and transfer of title. EquipMarket is not a party to those transactions.

6. SMS / Text Message Terms

By providing your mobile number and consenting (including verbally during a call with our team), you agree to receive text messages from EquipMarket at the number you provide, sent from (480) 791-2466. These messages relate to listing your equipment and to inquiries you have initiated.

Frequency: Message frequency varies and is typically low — often a single follow-up message plus any replies to a conversation you start.
Cost: Message and data rates may apply. EquipMarket does not charge for these messages.
Opt-out: Reply STOP at any time to stop receiving messages. Reply HELP for help, or email [email protected].
Consent is optional: Agreeing to receive text messages is not a condition of using the Platform or of any purchase.

Carriers are not liable for delayed or undelivered messages. For details on how we handle mobile information — including our commitment never to sell or share your number with third parties for marketing — see our Privacy Policy.

7. Acceptable Use

You agree not to post false, misleading, or fraudulent listings; not to infringe others’ rights; and not to use the Platform for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

8. Disclaimers & Limitation of Liability

The Platform is provided “as is” without warranties of any kind. To the fullest extent permitted by law, EquipMarket is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform or any transaction between users.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
